Resolving commercial disputes
We work with clients across a range of commercial and industrial sectors. Our aim is to implement an approach that fits a client’s needs while maximising outcomes and minimising costs. This means taking a pragmatic and commercial approach to disputes. If possible, this will be without recourse to legal proceedings. However, if that becomes unavoidable and the matter needs to go to Court, we will advocate our client’s position rigorously.
In Scotland, commercial disputes are heard in either the Sheriff Court or the Court of Session., with most being heard in the former, particularly those less complex or lower value.
Higher value (over £100,000) and more complicated cases are heard in the Court of Session. Where litigation cannot be avoided, we will be there to guide you through the process from beginning to end.
Considering the ‘bigger picture’
Experience and determination from our team when you need it the most.
Some commercial law firms offer no Court service. In larger firms, specialist commercial lawyers have little practical experience in litigation. Correspondingly, their litigation colleagues can be asked to deal with situations with limited knowledge of ‘the bigger picture’, including the commercial factors that may outweigh the purely legal issues. If our clients do get into a dispute, we can also handle litigation and dispute resolution.
